Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

However, by uploading User Submissions to the Service, you grant [RefTrace] a license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Service. This license will only be used for the purpose of operating, developing, providing, promoting, and improving the Service and for new service development." Data Protection and Privacy Clause on Personal Data and Messages: "We are committed to protecting the privacy of our users. Any personal data and messages submitted in conjunction with the waitlist and other interactions with the Service shall be managed in accordance with our Privacy Policy. By using the Service, you consent to such processing and you warrant that all data provided by you is accurate." No Warranty for Code Analysis Disclaimer Clause: "[RefTrace] does not guarantee that the Service will be error-free or uninterrupted. The results of any code analysis performed by the Service are provided 'as is' and 'as available' without warranties of any kind, either express or implied. We disclaim all warranties, including, but not limited to, the accuracy, completeness, or reliability of the code analysis, or the outcome of using the Service." Liability Regarding User-Generated Content Limitation of Liability Clause: "[RefTrace] shall not be liable for any claims, damages, or losses resulting from the use of any User Submissions or the Service itself. You agree to hold harmless and indemnify [RefTrace] from and against any third-party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages, suits, judgments, litigation costs, and attorneys' fees." Content Moderation Content Moderation Clause: "[RefTrace] reserves the right, but not the obligation, to monitor and edit or remove any User Submissions provided by users. We may remove any User Submission at any time, without prior notice and at our sole discretion, if deemed in violation of these Terms and Conditions." Changes to These Terms and Conditions Amendment Clause: "We reserve the right to amend these Terms and Conditions at any time. We will provide notice of any changes by posting the revised Terms and Conditions on the Service. Your continued use of the Service after the posting of changes constitutes your binding acceptance of such changes."
